1. Introduction and Acceptance

Welcome to Hamiena. These Terms of Service (Terms) govern your use of hamiena.store (the Website) and your purchases from us. The Website is operated by Hamiena from Madinah, Saudi Arabia. By browsing the Website, creating an account or placing an order, you agree to these Terms together with our Return & Refund Policy, Shipping Policy, Privacy Policy and Legal Notice. If you do not agree, please do not use the Website.

2. Eligibility

You must be at least 18 years old, or the age of legal capacity in your country, to place an order. If you are younger, a parent or guardian must place the order for you. You confirm that the information you give us is accurate and that you are legally able to enter a contract.

3. Your Account

You can order without an account where checkout allows it. If you create an account, please give accurate details, keep your password confidential and tell us promptly if you think your account has been used without permission. You are responsible for activity under your account. We may suspend an account that is used unlawfully or that breaches these Terms.

4. Your Responsibilities

You agree to provide a correct delivery address and working contact details, to use the Website lawfully, and to use products as their instructions and safety information direct. Please read product descriptions and specifications before ordering.

5. Product Information

We try to describe and photograph our products accurately. Colours may appear differently on different screens, and manufacturers may update packaging or minor specifications. If you believe a description is wrong, contact us before ordering. Information about fragrances, skincare and personal care items is general. Please check ingredients and warnings, and ask a doctor if you have allergies or a medical condition. Nothing on the Website is medical advice.

6. Availability

All products are subject to availability, and stock levels can change quickly. If a product you ordered turns out to be unavailable, we will tell you and offer a replacement or a full refund.

7. Prices, Currency and Taxes

• Prices are shown in Saudi Riyals (SAR).
• Applicable taxes, including VAT where required, are shown at checkout before you pay.
• Delivery charges, if any, are shown before you pay. We do not add a surcharge for the payment method you choose.
• Where we show a reduced price next to a previous price, the previous price is a price at which the product was genuinely offered by us. Sale prices apply for the stated period only.
• If a price is clearly wrong, we may cancel the order and refund you in full. We will not do so for ordinary price changes made before you order.
• We will issue an invoice for your order on request.

8. Orders and Acceptance

Placing an order is an offer to buy. We send an order confirmation to confirm we received it. A contract is formed when we send a shipping confirmation or otherwise confirm dispatch. We may decline or cancel an order, for example for stock, pricing errors, suspected fraud or an address we cannot serve, and if so we will refund any payment. We may contact you by phone, SMS or WhatsApp to confirm your details, especially for Cash on Delivery orders.

9. Payment

We accept the payment methods shown at checkout, which may include Cash on Delivery. Online payments are processed by secure third-party providers, and we do not see or store your full card details. Your order is processed once payment is authorised or, for Cash on Delivery orders, when you accept the parcel.

10. Cancellations

You can cancel an order before it is dispatched by contacting us. After dispatch, please follow our Return & Refund Policy. Customers may also cancel when delivery is more than 15 days late, as described in that policy.

11. Shipping and Delivery

We deliver to Saudi Arabia and the United Arab Emirates. Delivery times, fees, tracking and delivery attempts are set out in our Shipping Policy. Delivery dates are estimates, not guarantees, but you keep your right to cancel and be refunded for unreasonable delay. Risk in the product passes to you when it is delivered.

12. Returns and Refunds

Our Return & Refund Policy forms part of these Terms. It explains your statutory consumer rights and our additional store policy.

13. Intellectual Property

The Website and its content, including text, graphics, logos, layout and the name Hamiena, belong to us or our licensors and are protected by intellectual property laws. Brand names and logos of products we sell belong to their owners, and their appearance on the Website does not mean the owner endorses us. You may view and print pages for personal use. You may not copy, republish, scrape or use our content commercially without our written permission.

14. Reviews and Feedback

If you post a review or send us feedback, you confirm it is honest and based on real experience, and you give us a non-exclusive right to display it on the Website. We may remove content that is unlawful, abusive, misleading or off-topic. We do not publish fabricated reviews.

15. Prohibited Activities

You must not use the Website unlawfully or to commit fraud, place orders with someone else’s payment details without permission, interfere with the Website’s security or operation, use bots or scrapers, introduce malicious code, impersonate others, or resell our products using our images and descriptions without permission.

16. Third-Party Services and Links

We use third parties such as Shopify, payment providers and delivery companies. The Website may link to other sites. We do not control third-party sites and are not responsible for their content or practices, so please read their terms.

17. Limitation of Liability

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care. We do not exclude or limit liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or defective products, or any liability that the consumer protection laws of Saudi Arabia or the UAE do not allow to be limited. Subject to that, we are not liable for indirect or unforeseeable losses, or for delays and failures caused by events beyond our reasonable control, such as natural disasters, strikes, customs or government actions, or network outages.

18. Your Consumer Rights

These Terms do not affect your statutory rights as a consumer. No clause in these Terms is intended to remove a right given to you by mandatory law, and any clause that would do so does not apply to you. This includes your rights under the Saudi E-Commerce Law and consumer protection rules, and under the UAE Consumer Protection Law and e-commerce rules.

19. Governing Law and Disputes

We will first try to resolve any complaint informally. Write to gm859482@gmail.com and we will respond promptly. These Terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes are subject to the competent Saudi courts, without removing your right as a consumer to bring a complaint to the consumer protection authority of Saudi Arabia or the UAE, or to use the courts of your country of residence where the law gives you that right.

20. Changes to These Terms

We may update these Terms. The version published on the Website on the day you place your order applies to that order. The date at the top shows the latest version, and where a change is significant we will tell registered customers by email.
